A federal appeals court on Thursday said former Black Panther Mumia Abu-Jamal cannot be executed for murdering a Philadelphia police officer without a new penalty hearing.
The 3rd U.S. Circuit Court of Appeals said Abu-Jamal’s conviction should stand, but that he should get a new sentencing hearing because of flawed jury instructions. If prosecutors don’t want to give him a new death penalty hearing, Abu-Jamal would be sentenced automatically to life in prison.
From KW: I thought it was odd that the mainstream press cared enough to write about Mumia, and that the way they wrote, it seemed like Mumia won something – a new hearing. I fell for the old “make them think there cause is finished propaganda.” Sorry.
In fact, what Mumia and his defense team wanted was for Mumia to get an entirely new trial, or his conviction overturned. And, what they got was a big, fat, NO! and the tiny morsel of hope that he could have a new sentencing hearing and only face “death” or “life in prison.” So, there is still work to be done for Mumia’s supporters.
